Summary

The Maroon Office of the Secret Service has examined the activities of an entity styling itself the Elderberg Foundation, based in Sanford, Florida, which has solicited and received public donations under language associating it with the Maroons and with the Sovereign State of Accompong.

After review, the Office finds no lawful basis for the Elderberg Foundation to represent, receive funds on behalf of, or otherwise act for the State of Accompong. The Office declines to recognize the Elderberg Foundation as an instrument of the State, and advises the public accordingly.

This advisory is issued under the Office’s charge over the standing of the State and in keeping with the standing positions set out in the Threat Picture categories of Financial Schemes and External and Cyber Threats.

Findings of the Office

1. The Elderberg Foundation is not an office, agency, or instrument of the Sovereign State of Accompong.

The Foundation operates from 401 E 1st Street, Sanford, Florida, and describes itself as a “religious society of Moors/Maroons.” It holds no commission, warrant, or authorization from the lawful offices of the State of Accompong. No Letter of Permission under the seal of the Office of the Chief has been issued to it in any form known to this Office.

2. The Elderberg Foundation has no verified status as a United States tax-exempt charity.

Public searches of the United States Internal Revenue Service Tax Exempt Organization Search (TEOS), the ProPublica Nonprofit Explorer, and Candid / GuideStar return no record of the Elderberg Foundation as a recognized 501(c)(3) organization. The Foundation’s own website, elderberg.org, displays a donation counter reading “$0K Received Donations” — while public fundraising platforms have routed tens of thousands of US dollars in donations to it under charitable pretense.

3. The leadership of the Elderberg Foundation includes two parties whose claims to act outside the jurisdiction of the United States have been rejected by the United States federal courts.

Per the Foundation’s own public website at elderberg.org/our-team/, its named leadership consists of:

  • Anu Tafari Zion El — identified as Founder and Chairman
  • Dawud Allantu Bey — identified as Vice Chairman
  • Daryl Rose Bey — identified as Director

Mr. Anu Tafari Zion El and Mr. Dawud Allantu Bey were named appellants in Luminant Mining Company, L.L.C. v. PakeyBey et al., No. 20-40803 (5th Cir.), appealed from the United States District Court for the Eastern District of Texas, No. 6:19-CV-372. In that proceeding, the appellants filed a warranty deed in Rusk County, Texas, purporting to convey approximately 951 acres of land to Mr. Dawud Allantu Bey and the Amexemnu Taysha Trust, occupied the land, and attempted to harvest timber from it. The titleholder of the land, Luminant Mining Company, filed suit.

On September 17, 2021, the United States Court of Appeals for the Fifth Circuit affirmed summary judgment against Mr. Anu Tafari Zion El, Mr. Dawud Allantu Bey, and their co-appellants, on the ground that Luminant Mining had demonstrated by uncontested evidence its adverse and peaceable possession of the tracts for more than ten years under Texas law. The Supreme Court of the United States denied certiorari on May 23, 2022.

Throughout the proceeding, the appellants asserted they were acting as “sovereign freemen” outside the jurisdiction of the United States. That assertion did not prevail.

4. The Elderberg Foundation has been used to route public donations raised under the name of the Maroons and the State of Accompong.

At least one public fundraising campaign hosted on GoFundMe — soliciting funds for hurricane relief in Accompong — has designated the Elderberg Foundation as the receiving entity. As of the date of this Notice, that campaign reports approximately $78,187 USD received from 515 donors. The Foundation’s own website continues to display “$0K Received Donations.” The Office is unable to reconcile the two.

No corresponding public accounting, audited report, or verifiable disbursement of those funds to the people of Accompong has been made available for examination by this Office.

Position of the Office

The Maroon Office of the Secret Service:

  1. Does not recognize the Elderberg Foundation as an office, agency, fiduciary, pass-through, or representative of the Sovereign State of Accompong.
  2. Does not acknowledge any authority on the part of Mr. Anu Tafari Zion El, Mr. Dawud Allantu Bey, or Ms. Daryl Rose Bey to receive, hold, disburse, or solicit funds on behalf of the State, the Maroons, or the people of Accompong.
  3. Does not certify any representation by the Elderberg Foundation that it is a charitable organization, a tax-exempt entity, or a lawful recipient of donations given for the benefit of the State of Accompong or its people.
  4. Does not warrant the disposition of any funds that have been or may in future be routed through the Elderberg Foundation under the representation that they serve the Maroons or the State.

Public Warning

The Office advises members of the public, including members of the global Maroon diaspora, prospective donors, celebrity donors and their representatives, journalists, fundraising platforms, and any party contemplating contribution to the Elderberg Foundation:

Donations made to the Elderberg Foundation under the belief that they will reach the Maroons or the Sovereign State of Accompong cannot be confirmed by this Office to have that effect.

The Foundation is not recognized by the State. Its leadership has been the subject of the federal court findings described above. Its charitable status cannot be verified. Its own public accounting does not match the sums routed through it by third-party platforms.

Persons who have donated to campaigns routed through the Elderberg Foundation, or who have been solicited to do so, may wish to:

  • Consult the Fifth Circuit opinion cited above
  • Consult the IRS Tax Exempt Organization Search at irs.gov/charities-non-profits/tax-exempt-organization-search to verify the charitable status of any entity before donating
  • Contact the fundraising platform directly to inquire into its due diligence on the recipient entity
  • Report concerns to the United States Federal Trade Commission (reportfraud.ftc.gov), the Florida Department of Agriculture and Consumer Services (fdacs.gov), or the Internal Revenue Service (1-877-829-5500)

A Note on Scope

This advisory addresses the Elderberg Foundation and its named officers. It does not address, and makes no finding as to, any other entity, individual, or arrangement that may have been associated with the routing of the funds described herein. Such further matters, if they concern the standing of the State, remain within the scope of the Office’s continuing watch and will be addressed by separate notice as and when warranted.
